7. Enquiries and Initial Contact

Submitting an enquiry does not guarantee:

that a particular practitioner will be suitable for you;

A change to these Website Terms does not automatically alter a separate existing counselling agreement where separate agreement or notice would be required.
38. Electronic Communications
You acknowledge that communications relating to the Website, enquiries and bookings may take place electronically.
Where permitted by applicable law, electronic communications, acknowledgements, confirmations and agreements may have legal effect.
You are responsible for ensuring that contact information you provide is accurate and that you can receive communications sent to that contact information.
39. Events Outside Our Reasonable Control
Subject to applicable law, Coast Counselling will not be responsible for failure or delay in Website operation resulting from circumstances outside our reasonable control.
Such circumstances may include:

internet outages;

telecommunications failures;

power failures;
-
hosting-provider failures;
-
cyberattacks;
-
government restrictions;
-
natural disasters;
-
epidemics or public-health emergencies;
-
failure of third-party systems or software; or
-
other events that cannot reasonably be prevented.
Nothing in this section affects rights or liabilities that cannot lawfully be excluded.
40. Severability
If any provision of these Terms is determined by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will, where possible, be interpreted or limited to the minimum extent necessary to make it lawful and enforceable.
If that is not possible, the relevant provision will be treated as severed.
The remaining provisions will continue in effect.
41. No Waiver
If Coast Counselling does not immediately enforce a provision of these Terms, this does not constitute a waiver of the right to enforce that provision later.
A waiver relating to a particular circumstance does not constitute a general waiver of the relevant provision.
42. Assignment
You may not assign or transfer your rights or obligations under these Terms to another person without the prior written consent of Coast Counselling.
Coast Counselling may transfer rights or obligations associated with operation of the Website where reasonably necessary in connection with a lawful restructuring, transfer of the Practice or change of service provider, subject to applicable legal and data-protection obligations.
43. Third-Party Rights
Unless expressly stated otherwise, a person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any provision of these Terms.
This does not affect any right or remedy that may exist independently of that Act.
44. Entire Agreement Regarding Website Use
These Terms, together with the Privacy Policy and any other Website policy expressly incorporated into them, constitute the agreement between you and Coast Counselling concerning ordinary use of the Website.
They do not replace separate agreements concerning:

counselling services;

informed consent;

confidentiality;

professional boundaries;

fees;
-
cancellation arrangements;

clinical records; or
-
other professional services.
45. Governing Law
These Terms and disputes relating specifically to the use of the Website are governed by the laws of Singapore, subject to any mandatory rights that may apply under the laws of another jurisdiction and cannot lawfully be excluded.
46. Jurisdiction
Subject to any mandatory law providing otherwise, the courts of Singapore will have jurisdiction in relation to disputes arising from or connected with these Terms or use of the Website.
Nothing in this section prevents the parties from seeking to resolve a concern through direct communication or another mutually agreed dispute-resolution process before commencing legal proceedings.
